In a groundbreaking decision, the National Labor Relations Board (NLRB) ruled that workers at a company delivering packages for Amazon are considered employees of the e-commerce giant. Amazon’s claim that it had no responsibility for the subcontractor’s staff was rejected by the NLRB. This ruling came after a regional director in Los Angeles found merit in the accusations made by the delivery workers regarding Amazon’s unlawful actions. The workers claimed that Amazon refused to recognize their decision to unionize and failed to negotiate with the union over workplace issues.

The NLRB also discovered that Amazon had engaged in threatening employees, requiring workers to attend meetings designed to discourage union activity, and withholding information requested by the union. The delivery company, Battle-Tested Strategies, which operated out of Amazon’s DAX8 fulfillment center in Palmdale, California, had voluntarily recognized the decision by drivers to join a local chapter of the Teamsters union.

Amazon’s decision to terminate the contract with Battle-Tested Strategies led to the termination of jobs for 84 drivers who delivered Amazon packages. This ruling marked a significant win for Teamsters officials who challenged Amazon’s long-standing stance that they were not responsible for the working conditions of subcontracted drivers. The ruling could potentially pave the way for delivery drivers in other locations to unionize and demand negotiations with Amazon.

Teamsters General President Sean M. O’Brien hailed the ruling as a tremendous victory for Amazon drivers, stating that this decision makes it clear that Amazon is legally obligated to bargain with its drivers over their working conditions. The ongoing protests by the Teamsters at various Amazon facilities across the country reflect the unified effort to hold Amazon accountable for low wages and unsafe working conditions.

Although the NLRB did not find merit in all of the Teamsters’ allegations, including claims of retaliatory behavior by Amazon, the ruling still represents a significant step in addressing unfair labor practices. Amazon spokesperson Eileen Hards dismissed the allegations made by the Teamsters, indicating that they believe the remaining claims will also be dismissed.

The NLRB ruling serves as a crucial turning point in the ongoing battle for the rights of Amazon workers and the acknowledgment of their employment status. The decision highlights the importance of holding corporations accountable for their treatment of workers and sets a precedent for future negotiations and unionization efforts within the company.
